1. Introduction
Welcome to Noctra. These Terms of Service (referred to as “Terms”) govern your access to and use of the Noctra bot, the website noctra.xyz, and any related services or APIs (collectively, the “Service”). By using Noctra, you agree to be bound these Terms. If you do not agree, do not use the Service.
2. Definitions
- User: any individual or entity using the Service
- Data: information processed to provide the Service, such as server identifiers, user identifiers, channel identifiers, and message content required for functionality

3. Description of the Service
Noctra provides automation, moderation, utility, and interaction features, as well as APIs for integration with external services. All features are provided on an as-is and as-available basis. Features may be modified, limited, replaced, or discontinued at any time without notice.

You must meet the minimum age required to legally use the platform on which Noctra operates. By using Noctra, you confirm that you are legally permitted to use the Service in your jurisdiction.
5. User Responsibilities
You agree that you will:
- Use the Service lawfully and responsibly
- Not abuse, exploit, or attempt to pass technical limitations, security mechanisms, or rate limits
- Not use the Service for spam, malicious automation, harassment, or illegal activities
- Be solely responsible for the content and actions taken through servers where Noctra is used
6. Prohibited Conduct
You must not:
- Attempt to reverse engineer, decompile, or extract source code or proprietary logic
- Interfere with the stability, availability, or integrity of the Service
- Use Noctra in a manner that causes harm to infrastructure, users, or third parties
Violation may result in suspension or termination of access.
7. Data Processing and Privacy
Noctra processes Data strictly necessary to operate the Service, including identifiers and message content required for command execution, moderation, logging, diagnostics, and abuse prevention.
- Data is processed to perform the Service, maintain security, and improve functionality
- Operational logs and related data are retained for a limited period (generally up to 90 days) unless longer retention is required
- Users may request access, correction, or deletion of their data contacting support@noctra.xyz
8. Security
We implement reasonable technical and organizational safeguards to protect the Service and processed Data. No system is completely secure, and use of the Service is at your own risk.
9. Service Availability
Noctra does not guarantee uninterrupted availability. Downtime may occur due to maintenance, updates, infrastructure changes, or unforeseen technical issues. We are not liable for losses caused temporary unavailability.
10. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time. Continued use of the Service after changes constitutes acceptance of the updated Service behavior.
11. Disclaimer of Warranties
To the maximum extent permitted law, the Service is provided without warranties of any kind. We do not guarantee specific results, performance, or availability.
12. Limitation of Liability
Noctra shall not be liable for indirect, incidental, consequential, or special damages, including data loss, service disruption, or business interruption. Liability is limited to cases where exclusion is not legally prohibited.
13. Termination
We may suspend or terminate access at any time for violations of these Terms, misuse, or operational necessity. Upon termination, stored data may be deleted in accordance with our retention policy.
14. Intellectual Property
All rights, titles, and interests in Noctra, including branding, features, software, and infrastructure, are owned Noctra or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
15. API Usage
Use of the Noctra API is at your own risk. You are responsible for securing API credentials and complying with usage rules. API access may be restricted or revoked at any time.
16. Indemnification
You agree to indemnify and hold harmless Noctra and its operators from claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.
17. Proprietary Code and Licensing
Noctra does not publicly disclose proprietary backend or internal source code. Third-party components remain subject to their respective licenses.
18. Governing Law
These Terms are governed the laws of Germany, unless mandatory legal provisions require otherwise.
19. Changes to These Terms
We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
