1. Introduction

Welcome to Noctra. These Terms of Service (referred to as 'Terms') govern your access to and use of the Noctra bot, the website noctra.xyz, the Noctra API (api.noctra.xyz), game servers operated Noctra, and any related services, collectively referred to as the 'Service'.

By using any part of the Service, you agree to be bound these Terms. If you do not agree, do not use the Service.

• User: any individual or entity accessing or using any part of the Service
• Discord Bot: the Noctra bot operating on the Discord platform
• API: the Noctra API accessible at api.noctra.xyz, including all endpoints and integrations
• Bot Token: a Discord bot token voluntarily submitted a User to the API to enable authorized operations
• Game Server: any Minecraft or Steam-based game server operated Noctra
• Data: information processed to provide the Service, including identifiers, configuration data, message content, and credentials submitted for API use
• Noctra, we, us: the operator of the Service as identified in Section 2

4. Description of the Service

Noctra provides the following components:

• Discord Bot: automation, moderation, utility, and interaction features for Discord servers
• Website: information, documentation, and account management at noctra.xyz
• API: programmatic access to Noctra features and integrations at api.noctra.xyz
• Game Servers: community game servers for Minecraft and Steam-based games

All features are provided on an as-is and as-available basis. Features may be modified, limited, replaced, or discontinued at any time without prior notice.

5. Eligibility

You must meet the minimum age required to legally use the platform through which you access the Service. For Discord, this means you must be at least 13 years of age. For Minecraft and Steam, the respective platform age requirements apply. By using the Service, you confirm that you are legally permitted to do so in your jurisdiction.

6. User Responsibilities

You agree to:

• Use the Service lawfully, responsibly, and in accordance with these Terms
• Not abuse, exploit, or attempt to pass technical limitations, security mechanisms, or rate limits
• Not use the Service for spam, malicious automation, harassment, fraud, or illegal activities
• Be solely responsible for the content and actions taken through servers or integrations where Noctra is used
• Not submit API credentials, Bot Tokens, or other sensitive data that you are not authorized to use
• Comply with the terms and policies of Discord, Mojang/Microsoft, Steam, and Valve when using the respective components of the Service

7. Prohibited Conduct

You must not:

• Attempt to reverse engineer, decompile, or extract source code or proprietary logic from any part of the Service
• Interfere with the stability, availability, or integrity of the Service or its infrastructure
• Use the Service in a manner that causes harm to infrastructure, Users, or third parties
• Attempt to gain unauthorized access to other Users' data, credentials, or configurations
• Use the API to perform operations outside the scope of your explicit authorization
• Exploit vulnerabilities in Game Servers for unfair advantage, disruption, or unauthorized access

Violation of this section may result in immediate suspension or permanent termination of access, without prior notice.

8. API Usage

Access to and use of the Noctra API is subject to the following additional terms:

• You are solely responsible for securing your API keys and credentials
• API keys must not be shared, published, or transferred to third parties
• You may not use the API to scrape, mass-collect, or redistribute data obtained through the Service
• API access may be rate-limited, restricted, or revoked at any time without prior notice
• Noctra reserves the right to monitor API usage for abuse prevention and security purposes

9. Game Server Rules

By connecting to a Noctra-operated game server, you additionally agree to:

• Not cheat, hack, exploit bugs, or use unauthorized modifications that provide unfair advantages
• Not harass, threaten, or harm other players
• Respect in-game rules and instructions issued server administrators
• Accept that moderation decisions, including bans, are at the sole discretion of server administrators
• Not attempt to disrupt server performance through flooding, spam, or denial-of-service techniques

Violations may result in temporary or permanent bans from game servers, which may also result in termination of access to other parts of the Service.

10. Data Processing and Privacy

Noctra processes data strictly necessary to operate the Service. This includes Discord identifiers, message content, API credentials, game server session data, and server configuration. Full details are set out in our Privacy Policy.

• Data is processed to perform the Service, maintain security, and improve functionality
• Operational logs and related data are generally retained for up to 90 days
• Bot Tokens are retained only while the associated API integration is active
• Users may request access, correction, or deletion of their data contacting support@noctra.xyz

11. Security

We implement reasonable technical and organizational safeguards to protect the Service and processed data. This includes encrypted storage of API keys and Bot Tokens. No system is completely secure, and use of the Service is at your own risk. In the event of a security incident affecting your data, we will notify affected Users as required applicable law.

12. Service Availability

Noctra does not guarantee uninterrupted availability of any part of the Service. Downtime may occur due to maintenance, updates, infrastructure changes, or unforeseen technical issues. We are not liable for losses or damages caused temporary or permanent unavailability.

13. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, including features, APIs, game servers, or the Discord bot. Where reasonably possible, we will provide prior notice. Continued use of the Service after changes constitutes acceptance of the updated Service.

14. Disclaimer of Warranties

To the maximum extent permitted applicable law, the Service is provided without warranties of any kind, express or implied. We do not guarantee specific results, performance, uptime, or availability of any feature.

15. Limitation of Liability

To the maximum extent permitted law, Noctra and its operators shall not be liable for indirect, incidental, consequential, or special damages, including but not limited to data loss, service disruption, or business interruption arising from use of the Service. Liability is limited to cases where exclusion is not legally permissible under applicable German law.

16. Termination

We may suspend or terminate your access to any or all parts of the Service at any time, with or without notice, for violations of these Terms, misuse, abuse, or operational necessity. Upon termination, stored data may be deleted in accordance with our Privacy Policy and applicable retention periods.

17. Intellectual Property

All rights, titles, and interests in the Service, including branding, features, software, infrastructure, and documentation, are owned Noctra or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose in accordance with these Terms. No rights are transferred to you beyond what is strictly necessary for use of the Service.

18. Proprietary Code and Licensing

Noctra does not publicly disclose proprietary backend or internal source code. Third-party components used within the Service remain subject to their respective open-source or commercial licenses.

19. Indemnification

You agree to indemnify, defend, and hold harmless Noctra and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.

20. Governing Law and Jurisdiction

These Terms are governed and construed in accordance with the laws of the Federal Republic of Germany, excluding conflict of law provisions. To the extent permitted law, the place of jurisdiction shall be Hungen, Germany. Mandatory consumer protection provisions of your country of residence remain unaffected.

21. Changes to These Terms

We may update these Terms at any time. Where changes are material, we will notify Users updating the 'Last Updated' date and, where feasible, through an announcement via the Service. Continued use of the Service after updated Terms have been published constitutes acceptance of those Terms.
